Overview

This Privacy Policy describes how MarketMasher.com ("this Application") collects, uses, and processes Personal Data from its Users. MarketMasher.com is a marketing automation and content intelligence platform operated by Launch Ninjas, Inc.

Users may be subject to different protection standards, and broader standards may therefore apply to some. Users can contact the Owner to learn more about applicable standards.

This document contains a dedicated section for Users in the European Union and their privacy rights under the GDPR, and a dedicated section for Users in the United States and their privacy rights under applicable US state laws.

Owner & Data Controller

Types of Data Collected

Among the types of Personal Data that this Application collects, by itself or through third parties, there are:

Personal Data may be freely provided by the User, or, in the case of Usage Data, collected automatically when using this Application. Unless specified otherwise, all Data requested by this Application is mandatory and failure to provide this Data may make it impossible for this Application to provide its services.

In cases where this Application specifically states that some Data is not mandatory, Users are free not to communicate this Data without consequences to the availability or the functioning of the Service. Users who are uncertain about which Personal Data is mandatory are welcome to contact the Owner.

Any use of Cookies, or of other tracking tools, by this Application or by the owners of third-party services used by this Application serves the purpose of providing the Service required by the User, in addition to any other purposes described in this document.

Users are responsible for any third-party Personal Data obtained, published or shared through this Application.

How We Process Data

Methods of Processing

The Owner takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data. Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated.

In addition to the Owner, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this Application (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The updated list of these parties may be requested from the Owner at any time.

Place of Processing

The Data is processed at the Owner's operating offices and in any other places where the parties involved in the processing are located. Depending on the User's location, data transfers may involve transferring the User's Data to a country other than their own.

Retention Time

Unless specified otherwise in this document, Personal Data shall be processed and stored for as long as required by the purpose for which it was collected and may be retained for longer due to applicable legal obligations or based on the Users' consent.

The Data concerning the User is collected to allow the Owner to provide its Service, comply with its legal obligations, respond to enforcement requests, protect its rights and interests (or those of its Users or third parties), detect any malicious or fraudulent activity, as well as the following purposes:

We respect the privacy of our users and are committed to protecting personal information, including data obtained through Google APIs and Google services.

Who We Share Information With

We do not sell, rent, trade, or otherwise disclose personal information or Google user data to third parties for advertising, marketing, or data brokerage purposes.

We may share information only in the circumstances described below.

Service Providers and Subprocessors

To provide and operate our services, we may share information with trusted third-party service providers that perform services on our behalf. These providers may include:

Artificial Intelligence Service Providers

Certain features of our platform use third-party artificial intelligence providers to process content submitted by users.

Our current AI service providers include:

When users choose to use AI-powered features, information submitted through those features may be transmitted to OpenAI or Anthropic solely for the purpose of providing the requested functionality, including generating, rewriting, summarizing, analyzing, classifying, transforming, or otherwise processing content.

We share only the information necessary to provide the requested service.

We do not sell personal information or Google user data to OpenAI, Anthropic, or any other AI provider.

Data obtained through Google Workspace APIs is not used by us, OpenAI, or Anthropic to develop, improve, or train generalized artificial intelligence or machine learning models.

Google User Data

If users connect Google services to our platform, we may access and process Google user data only as necessary to provide the features and functionality requested by the user.

Google user data may be shared with OpenAI and Anthropic only when required to perform AI-powered functions that the user has explicitly requested.

We do not:

• Sell Google user data.
• Use Google user data for advertising purposes.
• Share Google user data with unrelated third parties.
• Use Google user data to build user profiles for advertising.
• Use Google Workspace API data to develop, improve, or train generalized artificial intelligence or machine learning models.

Access to Google user data is restricted to authorized systems and personnel who require access to operate, secure, maintain, or support our services.

User-Directed Sharing

Our services may allow users to publish, export, synchronize, or distribute content to third-party platforms and services.

When a user initiates such an action, we may transfer the necessary information to the selected third-party service solely to complete the requested action.

Examples may include:

• Publishing content to websites or blogs
• Posting content to social media platforms
• Sending emails or newsletters
• Exporting reports or content
• Synchronizing information with connected applications

Legal Requirements

We may disclose information when required to do so by law or when we reasonably believe disclosure is necessary to:

• Comply with legal obligations, regulations, court orders, or governmental requests;
• Protect our rights, property, or security;
• Prevent fraud, abuse, or security incidents;
• Protect the safety of users or the public.

Business Transfers

Further Information for Users in the European Union

This section applies to all Users in the European Union, according to the General Data Protection Regulation ("GDPR"), and for such Users supersedes any other possibly divergent or conflicting information contained in this privacy policy.

Legal Basis of Processing

The Owner may process Personal Data relating to Users if one of the following applies: Users have given their consent for one or more specific purposes; provision of Data is necessary for the performance of an agreement with the User and/or for any pre-contractual obligations thereof; processing is necessary for compliance with a legal obligation to which the Owner is subject; processing is related to a task that is carried out in the public interest or in the exercise of official authority vested in the Owner; processing is necessary for the purposes of the legitimate interests pursued by the Owner or by a third party.

Retention Time

Unless specified otherwise, Personal Data shall be processed and stored for as long as required by the purpose for which it was collected and may be retained for longer due to applicable legal obligations or User consent. Personal Data collected for contract performance shall be retained until the contract is fully performed. Personal Data collected for legitimate interests shall be retained as long as needed to fulfill such purposes.

System Logs and Maintenance

For operation and maintenance purposes, this Application and any third-party services may collect files that record interaction with this Application (System logs) or use other Personal Data (such as the IP Address) for this purpose.

Changes to This Privacy Policy

The Owner reserves the right to make changes to this privacy policy at any time by notifying its Users on this page and possibly within this Application and, as far as technically and legally feasible, sending a notice to Users via any contact information available to the Owner. It is strongly recommended to check this page often, referring to the date of the last modification listed at the top of this document.

Should the changes affect processing activities performed on the basis of the User's consent, the Owner shall collect new consent from the User, where required.

Definitions and Legal References

Personal Data (or Data) / Personal Information (or Information)

Any information that directly, indirectly, or in connection with other information, including a personal identification number, allows for the identification or identifiability of a natural person.

Sensitive Personal Information

Sensitive Personal Information means any Personal Information that is not publicly available and reveals information considered sensitive according to the applicable privacy law.

Usage Data

Information collected automatically through this Application (or third-party services employed in this Application), which can include: the IP addresses or domain names of the computers utilized by the Users who use this Application, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server's answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilized by the User, the various time details per visit (e.g., the time spent on each page within the Application) and the details about the path followed within the Application with special reference to the sequence of pages visited, and other parameters about the device operating system and/or the User's IT environment.

User

The individual using this Application who, unless otherwise specified, coincides with the Data Subject.

Data Subject

The natural person to whom the Personal Data refers.

Data Processor (or Processor)

The natural or legal person, public authority, agency or other body which processes Personal Data on behalf of the Controller, as described in this privacy policy.

Data Controller (or Owner)

The natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Data, including the security measures concerning the operation and use of this Application. The Data Controller, unless otherwise specified, is the Owner of this Application.

This Application

The means by which the Personal Data of the User is collected and processed.

Sale

Sale means any exchange of Personal Information by the Owner to a third party, for monetary or other valuable consideration, as defined by the applicable privacy US state law. The exchange of Personal Information with a service provider pursuant to a written contract that meets the requirements set by applicable law does not constitute a Sale of your Personal Information.

Sharing

Sharing means any sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer's Personal Information by the business to a third party for cross-context behavioral advertising, whether for monetary or other valuable consideration, as defined by California privacy laws.

Targeted Advertising

Targeted advertising means displaying advertisements to a consumer where the advertisement is selected based on Personal Information obtained from that consumer's activities over time and across nonaffiliated websites or online applications to predict such consumer's preferences or interests, as defined by the applicable privacy US state law.

European Union (or EU)

Unless otherwise specified, all references made within this document to the European Union include all current member states to the European Union and the European Economic Area.

Cookies are Trackers consisting of small sets of data stored in the User's browser.

Tracker

Tracker indicates any technology, e.g. Cookies, unique identifiers, web beacons, embedded scripts, e-tags and fingerprinting, that enables the tracking of Users, for example by accessing or storing information on the User's device.
